Paratalks Private Limited (“Paratalks” “Paratalks Website” “Paratalks Mobile Application” “We” “Us” “Our”) is in the business of facilitating connections between consumers (hereinafter the “User”) (collectively “User” “You” “Your” “Client”) seeking therapy/consultation-related solutions whether online or offline and Service Professionals (“Professionals” “Service Professionals” “Paraexperts”) across various fields who provide these Services.
These Terms and Conditions (hereinafter the “Terms”) describe and govern the use of Services available on or through the Paratalks Website available at Paratalks.in and Paratalks Mobile Application (collectively hereinafter the “Platform”). These Terms also include our Privacy Policy available at https://paratalks.in/privacy-policy and any guidelines, policies, and disclaimers issued by us from time to time.
The Terms constitute a binding and enforceable legal contractual obligation between Paratalks Private Limited (a company incorporated under the Companies Act 2013 with its registered address at B-408SHAKUN ELEGANCE P.I.P. Kota Kota Kota- 324005 Rajasthan) and the User of the Platform. By accessing the Platform and/or utilising the Services you confirm that you have read, understood, and consented to be bound by these Terms as amended from time to time and agree to comply with the conduct and obligations stated herein. If you do not agree with any or all of the Terms including the Privacy Policy and other guidelines made available by Paratalks, then please refrain from using the Services. In such an event, refrain from clicking on the &aspos;I Agree' button or any other option that may indicate your absolute and express consent.
Unless stated otherwise, the following terms shall have the meaning described herein:
You hereby acknowledge and agree that in addition to these Terms, the Platform may, in accordance with the Privacy Policy and applicable law, collect, use, store, and/or transfer your personal information and data. It is advised that before you access, use, or register on the Platform, you read and understand the Privacy Policy.
You hereby agree that we may disclose your information if required to do so by law or on a good faith belief that such disclosure is permitted by the Privacy Policy or reasonably necessary or appropriate for marketing and promotional offers, enhancement of Services and User experience, or research and statistical data.
To avail the Services made available on the Platform, Users are required to register by creating an Account on the “Sign Up Page” section on the Platform. The User at any given point shall not have more than one active Account with the Platform. The User may only login from one device at any given time and the Platform shall facilitate all chats, audio calls, and video calls and sessions from that device only. Any communication between the User and the Service Professional shall be facilitated through the Platform. Therefore, the User must ensure that the Platform is downloaded, logged in, the device is connected to the internet, and all required permissions are granted.
By registering on the Platform, you ensure that the information provided by you is accurate, up-to-date, and true. You hereby agree to update and correct any inaccurate or deficient information.
If at any point it is revealed or found that the information supplied by you is incorrect, inaccurate, incomplete, false, untrue, or not up-to-date, we reserve the right to suspend or terminate your Account and/or refuse or restrict your use of the Platform in the future.
The access to a User’s Account shall remain solely with the User and the User shall bear the sole responsibility of preventing the use of such an Account by any third-parties or intruders. The use of personal information of a User’s Account by another is expressly prohibited under these Terms and the Account created by a User is non-transferable. The User shall be solely and absolutely responsible for all activities that occur under the User’s Account with the Platform.
Please note that the User bears the sole responsibility of keeping their passwords, OTPs, and other confidential/restricted information safe from misuse by intruders. The owner of the device shall take reasonable measures to keep their Account safe and out of reach of intruders and any unauthorised use of your Account shall not be our responsibility. It is advised that in case the User becomes aware of any unauthorised use of their Account or any breach of security, they contact us immediately.
Please note that the collection, use, storage, and transfer practices of Paratalks regarding the personal information or data provided by you is described in and governed by the Privacy Policy.
All the Services provided on the Platform are intended for use by the targeted audience only. Misuse by non-targeted audiences shall be prevented by the owner of the mobile/cellular device.
The Services are intended for Users over the age of 18 and are not directed at children under the age of 12. By accessing the Platform and utilising the Services therein, you confirm that you are over the age of 18 and are legally competent as per the Indian Contract Act 1872. The Platform shall not in any way or form be responsible for the use or misuse of the Platform by minors or persons incompetent or disqualified by law. You are, however, permitted to ask questions, discuss, and utilise the Services on behalf of the aforementioned individuals.
If at any point it is revealed or informed to us that the Platform or the Services provided therein are being accessed by the aforementioned person, we shall take reasonable steps to restrict/delete their Account as soon as practicable. If you are a parent or guardian and the use of the Platform by such aforementioned persons has come to your knowledge, then it is advised that you take reasonable measures to prevent such use and contact us immediately.
The User hereby agrees to unconditional and unreserved access of their User Account including but not limited to Live-sessions, Chats, QnA, Therapy/Consultations, Audio Calls, and Video Calls by the Platform, third-party authorities, employees, and agents.
Please Note, we shall retain access to the Account and any information provided by you therein which shall enable us to maintain high-quality Services and seamless User experience.
The User Account shall also be subject to inspection in case of any complaints, disputes, or suspected abuse or violation of these Terms including the Privacy Policy and other guidelines.
In addition, the User consents to the access of chats, audio, and video calls by the Platform, third-party authorities, agents, and employees to ensure no personal information is shared over live-sessions, chat, audio call, or video call to the third-party service providers including the Service Professionals to ensure the safety of the User.
The Services encompass the provision of the Platform allowing Users to interact with Service Professionals and utilise other features, functionalities, and packages via chat, QnA, audio and video calls, live-sessions, as well as arranging and scheduling web-based or home-based Services. As a part of the Services, we also facilitate payment transfers to Service Professionals for the Services they render to you. Additionally, the Platform also offers products and merchandise for sale.
The Platform is intended solely for your personal and non-commercial use unless expressly agreed otherwise. Paratalks reserves the right to modify or discontinue, temporarily or permanently, the Services or any part of them with or without notice at its sole discretion. You agree that Paratalks shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
The Platform facilitates the communication between Users and Service Professionals and does not endorse, recommend, or ensure the accuracy or reliability of any opinion, advice, or statement made through the Platform. The use of any information or materials on this Platform is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, Services, or information available through this Platform meet your specific requirements.
The User shall use the Platform solely for personal purposes and shall not misuse, exploit, or commercialise the Services or the Platform for any unauthorised or unlawful purposes. The User shall not interfere with, disrupt, or attempt to gain unauthorised access to the Platform or its related systems or networks. The User shall respect the privacy and confidentiality of other Users and Service Professionals.
The User shall not upload, post, transmit, distribute, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another&aspo;s privacy, hateful, or racially, ethnically, or otherwise objectionable.
To the fullest extent permitted by applicable law, Paratalks shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Paratalks has been advised of the possibility of such damages) arising out of or in connection with the Platform or these Terms.
Paratalks shall not be responsible or liable for any loss or damage of any sort incurred as the result of any interactions between Users and Service Professionals. Any relationship you establish with a Service Professional is strictly between you and such Service Professional. You acknowledge that Paratalks is not responsible or liable for any conduct of any Service Professional.
These Terms and any disputes arising from or related to these Terms or the use of the Platform shall be governed by and construed in accordance with the laws of India. Any disputes or claims arising out of or relating to these Terms or the use of the Platform shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The place of arbitration shall be Kota, Rajasthan, and the language of arbitration shall be English.
